Farmstand Terms of Service

Version 1 — effective August 1, 2026. These terms are between the farm ("you") and Farmstand ("we", "us") and cover your use of Farmstand to manage farm records, websites, customers, checkout, inventory, subscriptions, email, and related tools. This draft is pending review by counsel; material changes will be issued as a new version and you will be asked to accept it before continuing to use the dashboard.

Accounts

You are responsible for keeping your login secure, entering accurate farm and business information, and making sure anyone you invite to your farm workspace is allowed to access that farm's data. You must be 18 or older and authorized to act for the farm you register.

Payments and Fees

Farmstand may charge plan fees, transaction fees, storage fees, email-contact add-ons, domain services, hosted email services, or other optional charges shown before purchase. Payments are processed by Stripe and other providers. A transaction fee may include payment-processing costs and Farmstand's platform fee.

Payment Processing (Stripe Connect)

Sales on your storefront are processed through Stripe Connect into your own connected Stripe account. You are the merchant of record for sales to your customers. You are responsible for the accuracy of your Stripe account information and for complying with Stripe's own terms of service.

Farmstand Is Not a Party to Your Sales

Farmstand provides software. Sales made through your storefront, point of sale, reservations, or subscriptions are between you and your customer. Farmstand is not the seller, is not a party to those transactions, and does not guarantee your products, your fulfillment, or your customers' payments. Refunds, replacements, and disputes with your customers remain your responsibility.

Subscriptions, Cancellation, and Refunds

Paid Farmstand plans renew automatically (monthly or annually) until cancelled. You can cancel anytime from Settings → Billing; cancellation takes effect at the end of the current billing period and you keep paid features until then. Plan fees already charged are generally non-refundable, except where required by law or for billing errors on our part — contact us within 30 days of an incorrect charge and we'll make it right. Transaction fees apply to completed sales and are not refunded when you refund a customer. Domain registrations and other third-party purchases (e.g. hosted email) are non-refundable once provisioned.

Farmer Responsibilities

You are responsible for products, pricing, fulfillment, taxes, food-safety compliance, permits, licenses, animal-health requirements, labeling, refunds, delivery, pickup, and promises made to your customers. Farmstand provides tools and records, but it does not provide legal, tax, veterinary, or accounting advice.

Acceptable Use

You may not use Farmstand to break the law, infringe others' rights, send spam, host malicious code, misrepresent your products, or interfere with the platform or other farms. You may not resell or white-label Farmstand without a written agreement.

Suspension and Termination

We may suspend some or all of your farm's platform features (including your public storefront, checkout, email sending, uploads, or dashboard access) if we reasonably believe your account is being abused, is violating these terms, presents a security or legal risk, or has unpaid fees. Suspension does not delete your data. We will tell you why and how to resolve it, and we restore features when the issue is resolved. You may close your account at any time; we may terminate with notice if a violation is not cured.

Data Ownership and Export

Your farm data remains yours. You may export core records where export tools are provided, including after cancellation for a reasonable wind-down period. Farmstand may process data to provide the service, prevent abuse, improve reliability, and support billing, checkout, email, storage, and domain features.

Availability and Disclaimer

Farmstand is an early product provided "as is" and "as available." We work hard to keep it available, but we do not guarantee uninterrupted service during beta, maintenance, provider outages, or security events. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Farmstand's total liability for any claim arising out of these terms or the service is limited to the amounts you paid Farmstand in the twelve months before the claim. Farmstand is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost sales, or lost data.

Indemnification

You will defend and hold Farmstand harmless from claims arising out of your products, your sales, your content, your regulatory compliance, or your violation of these terms.

Governing Law and Disputes

These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Tennessee, and you consent to their jurisdiction.

Changes to These Terms

We may amend these terms by issuing a new version with a new effective date. You will be asked to accept the new version before continuing to use the dashboard. The version you accepted, and when, is stored with your account.
